Congressman Moves To Invoke 25th Amendment; Trump Would Be Removed As President


Even if you set aside Trump’s involvement with Russia, the fact that he is preparing a basket of deliverables for Putin, and his sheer incompetence on issues that a President should be prepared for, Donald Trump is still unfit to be the President of the United States. And now, Congress is preparing a commission to remove him from office.

Representative Jamie Raskin of Maryland has forwarded a bill that would make it possible to remove a sitting president if he was deemed mentally unfit. This bill would uses the legal authority granted in the 25th Amendment of the Constitution which provides for the Vice-President to temporarily serve as the POTUS if the majority of the President’s cabinet determines that the President is “unable to discharge the powers and duties of office.”

Raskin is looking to create and eleven-member commission that would be composed of psychiatrists and physicians that would conduct a series of medical exams to determine if the President is capable of fulfilling his/her oath of office.

According to Raskin’s proposal, the commission would also be comprised of two former, high ranking US officials. This would allow for the input of former presidents, vice presidents, former secretaries of state and/or attorneys general.

The 25 Amendment provides for the decision to remove a President based on a majority of the President’s Cabinet or “such other body as Congress.” The congressman is looking to utilize his commission to serve as that “body.”

The commission would require a two-thirds majority of Congress to have their recommendation enforced. The President could appeal the decision of the commission and without two-thirds approval of Congress, the President would be able to assume the office.

Raskin cited Donald Trump’s recent Twitter tirade as the driving force behind his push. Over the last few days, the President has engaged in a Twitter war with MSNBC hosts Joe Scarborough and Mika Brzezinski.

Trump was roundly condemned by members of both parties.

Clearly, Trump did not care one bit about what his own party members said. Saturday morning, he doubled-down on the insults with a new attack on the MSNBC duo:

Trump’s behavior has been beyond the pale. It’s clear that he is not only not competent enough to serve as president, he is not mentally mature enough to fulfill his oath of office and there isn’t a day that goes by that he doesn’t further reduce the respect and dignity of the office of the President of the United States.

Raskin’s proposal is certainly a long-shot. However, it would provide Congress and the President’s cabinet a way to remove Trump from office without them having to directly to it. It would also serve as a means of removing Trump without impeachment proceedings.

So the possibility of this succeeding is not completely unfathomable. If Donald Trump becomes two great a liability for Republican lawmakers, it is not inconceivable that Republicans would look for a way out.

And if Republicans ever stop placing party over country, the reality of Trump’s incompetence and lack of mental maturity should serve as evidence enough that he needs to be removed from office.
