The Trump administration has been marked by scandal after scandal in the year or so that the belligerent businessman Donald Trump has been in power. Besides limping along under the weight of the Russia investigation, the significance of which the president continually chooses to dismiss, the Trump administration has also been rocked recently by the revelation that the president’s personal lawyer facilitated a payoff of $130,000 in hush money to an adult film star to keep her quiet about an affair with Trump.

After Trump’s lawyer Michael Cohen confirmed that the payment had been made and thus seemingly violated the non-disclosure agreement that accompanied the cash, the adult film actress, known as Stormy Daniels, revealed through her lawyer that she feels she is now free to tell her story. Now, she’s suing the president in order to be formally released from the agreement, and in light of the suit, her lawyer Michael Avenatti went on NBC this Wednesday morning to discuss the situation.

During his appearance on the Today show, Avenatti, besides confirming that his client had a sexual relationship with the president, cast doubt on the perspective that Cohen facilitated the hush money payment to Daniels completely of his own accord.

As he put it:

‘There’s no question the president knew about it at the time. The idea that an attorney would go off on his own, without his client’s knowledge and engage in this type of negotiation and enter into this type of agreement quite honestly is ludicrous.’

He went on to assert that the reason he believes to underlie the president not having signed the non-disclosure agreement that went with the cash is so that he could have a level of deniability about the whole thing.

Avenatti also maintained that his client has filed her lawsuit against the president in the face of incessant “misinformation” spread by his camp about the situation. Part of that misinformation is in the form of a statement denying an affair with the president that Avenatti claims Cohen got his client to sign via “force and intimidation.”

For now, Daniels’ lawsuit against the president is continuing to proceed. To begin with, the whole issue is ironic, considering the fact that the president supported by the “family values” crowd is allegedly guilty of these allegations of having an extramarital affair and lying to cover it up.

Besides that, however, the payment to Daniels has raised questions for some about the president’s compliance with federal election law.

California Democratic U.S. Rep. Ted Lieu posted a straightforward statement to that effect Tuesday, reading:

‘Hush agreement & side letter attached to Stormy Daniels’ filing essentially shows coordination between @realDonaldTrump, Cohen & Daniels. That means the $130k payment from Cohen to Daniels to silence her during the campaign violated federal election law. Penalty is 5 year felony.’

An idea is that the payment should be considered a campaign contribution, since it was done for the benefit of the campaign. That would make the payment, for which it’s still somewhat an open question whether or not Cohen was reimbursed, illegal since it’s above the maximum allowable amount for a campaign contribution. That’s the perspective held to by the government watchdog group Common Cause, which filed a suit against the Trump administration over the matter recently.
