In yet another devastating blow to Donald Trump, just one vote ruined the chances of Thomas Farr becoming a judge in the Eastern District of North Carolina. The “no” vote was decided by Senator Tim Scott of South Carolina who joins all Democratic Senate members as well as Jeff Flake, who opposed Farr. The total nays place Farr just behind the needed 50 votes required for Vice President Mike Pence to break a potential tie.

Senator Menendez (New Jersey) on the Senate floor today, urging his colleagues to vote against Farr:

Keeping his word, Senator Jeff Flake announced that he will vote “no” on every single judicial nominee until he is able to vote on legislation to protect special counsel Robert Mueller from being fired by the Trump administration.

Republicans are panicking just ahead of January 1st, 2019, when Democrats will lead the House of Representatives and lay down the law of the land in efforts to begin a plethora of checks and balances on the criminal Trump administration. In the meantime, Republicans on the Hill are hell-bent on passing through as many judicial nominees as they can before that time. Jeff Flake’s announcement a few weeks back pissed off his counterparts because the move certainly set hurdles in the way of what they likely perceived to be a cake-walk. They were wrong.

Of those who have cast the “no” votes, Farr’s past has weighed heavily on their minds. Of them, Farr’s track record of being unjust and quick to discredit minorities from all walks of life. In reference to a 1990’s Justice Department investigation, Tim Scott (who is black) said:

‘This week, a Department of Justice memo written under President George H.W. Bush was released that shed new light on Mr. Farr’s activities. This, in turn, created more concerns’

He further added that he is:

‘ready and willing to support strong candidates for our judicial vacancies that do not have lingering concerns about issues that could affect their decision-making process as a federal judge, and I am proud that Senate Republicans have confirmed judges at a historical rate over the past two years.’

Ouch. I bet both Trump and Thomas Farr can feel the burn.

As a reminder, this is not the first time that Scott has voted “no” for a Trump appointee. In July, the White House was forced to withdraw Ryan Bound’s nomination because he didn’t come close to having enough support on the Hill.
