After Donald Trump nominated Brett Kavanaugh to the Supreme Court it caused a wild fight in Congress. Trump was purposely trying to make the court a hard-line conservative one. Well yesterday, he and the rest of the nation learned that Kavanaugh just may not be as far to the right as he thought after Kavanaugh voted with the other liberal justices in a Planned Parenthood case, and now conservatives are losing their minds over it.
Yesterday, the Supreme Court declined to review three cases relating to Republican efforts to defund Planned Parenthood at the state level. The case came before the court after Republican state leaders in Louisiana and Kansas stripped Planned Parenthood of state Medicaid funds after a pro-life advocacy group presented evidence that the abortion-provider was harvesting and selling fetal materials. The legal question in today’s case was whether Medicaid recipients can challenge the disqualification of a provider under the Medicaid law.
The “evidence” the pro-life group presented was bogus so Planned Parenthood and several unnamed female patients sued the states in federal court. The 5th U.S. Circuit Court of Appeals sided with Planned Parenthood and the case ended up with the Supreme Court.
Conservative Justice Clarence Thomas was incensed with Kavanaugh and admitted that he wants the Supreme Court to be as political as possible even if it doesn’t follow the law. In his dissent, he wrote:
‘So what explains the Court’s refusal to do its job here? I suspect it has something to do with the fact that some respondents in these cases are named Planned Parenthood.
‘Some tenuous connection to a politically fraught issue does not justify abdicating our judicial duty. If anything, neutrally applying the law is all the more important when political issues are in the background.’
But here’s the big kicker…Kavanaugh wasn’t the only other conservative justice who voted against hearing the case. Chief Justice John Roberts, who is part of the conservative side also voted against hearing it. So that left the vote 6 to 3 against the court getting involved. The only justices who voted for it were Thomas, Neil Gorsuch, and Samuel Alito.
Pro-life groups hit the roof over the court’s refusal to hear the case. Marjorie Dannenfelser, president of the Susan B. Anthony List, said:
‘The pro-life citizens of states like Kansas and Louisiana, through their elected representatives, have clearly expressed their will: they do not want Medicaid tax dollars used to prop up abortion businesses like Planned Parenthood.’
Although conservatives trying to make this case all about abortion it’s way more than that. Planned Parenthood does more good for women’s health than almost any other organization in the country. They provide very important breast exams, pap smears, pregnancy tests, prenatal care, birth control, sexual education, screening and treatment for sexually transmitted diseases, and participate in research studies. They also perform sterilization procedures on women and men. Abortions only account for 3 percent of all the things they provide.
The justices were correct in turning this case away, because of if red states are allowed to defund Planned Parenthood it would start costing people their lives. It’s disheartening that conservatives on the Supreme Court want to turn the court as partisan as possible. They don’t care what the law says as long as they can sit on their thrones and divide this country even more than it already is. The 5th Circuit Court ruled that states couldn’t defund Planned Parenthood in this case, so it’s not like the law wasn’t already involved.
Conservatives are just mad because they couldn’t get their way. One thing is for sure Donald Trump must be steaming mad tonight. Although he doesn’t really care about abortion one way or the other, he’s going to see this as Kavanaugh being disloyal to him. There’s no telling what the fallout will be like once Trump starts running his mouth but it’s certainly going to be fun to watch.
