Judge Issues Georgia Voting Machine Restraining Order

Outspoken Texas attorney Sidney Powell filed a lawsuit in federal courts last week. She joined the Donald Trump legal team and then got canned within a very few days. Now, it appears she is back. Her suit alleges widespread voter fraud in Georgia’s presidential election. The judge issued an order Sunday night that froze the voting machines in three counties.

US District Judge Timothy Batten Sr. wrote a four-page directive and held a Zoom hearing which was not open to the press or the public. The lawsuit claimed that Georgia’s election results were “wildly inaccurate,” due to the Dominion Election Systems voting machines. 

Powell claimed that the company had foreign ties that made it possible for these voting machines to allow foreign meddling in our elections. This was a well-used conspiracy theory.

Such claims may inhibit Republican voter turnout in the January 5 election for two US Senate seats. These are exceedingly important seats, because they determine whether the Democrats or the Republicans control the Senate.

Batten provided a temporary restraining order applicable to the Dominion voting machines in Georgia’s Cobb, Gwinett, and Cherokee counties. The first two went for President-elect Joe Biden, and the last one favored Trump.

Judge Batten, an appointee of President George W. Bush wrote, The Politico reported:

‘Defendants are hereby enjoined and restrained from altering, destroying, or erasing, or allowing the alteration, destruction, or erasure of, any software or data on any Dominion voting machine in Cobb, Gwinnett, and Cherokee Counties.’

On Twitter, Powell’s co-counsel, Georgia attorney Lin Wood, wrote:

‘What??? Machines are owned by State & @GaSecofState administers state laws on elections. Why are GA officials determined to wipe these machines clean….Your guess is as good as mine.’

The president appeared on the Fox Business Channel Sunday where he commented:

‘This election was over. And then they did dumps. They called them dumps. Big massive dumps in Michigan, and Pennsylvania, and all over. ‘he governor’s done nothing. He’s done absolutely nothing. I’m ashamed that I endorsed him.’

Trump continued complaining about the Georgia officials on Sunday. He claimed that they betrayed the Republican party. In addition, he insisted they were hiding the truth about the elections by insisting they were clean.

Batten wrote:

‘counsel for the defendants in the suit — Gov. Brian Kemp (R-Ga.), Secretary of State Brad Raffensperger and four other members of the Georgia Elections Board — argued that the court had no jurisdiction over the counties because they are not parties to the case.’

In addition, the defendants argued letting experts for the plaintiffs inspect the Dominion machines “would pose substantial security and proprietary/trade secret risks.”

The judge wrote in his direction that state official defendants in the case and possibly even those in the affected counties could immediately appeal the restraining order to the 11th Circuit Court of Appeals.
