3-Judges Sternly Dismiss GOP Election Sabotage Attempt

Maybe, Donald Trump is trying to file an election lawsuit for every year he is old. The New York Times showed he and his minions have filed “over 60 lawsuits,” thus far. He is 74, so we may have another dozen or so coming. How many did he win? Just one, a lonely only one, and that was on a technicality. Now, there is another lawsuit to pile on the electoral lawsuit pyre, the structure used in ancient cremations.

The Arizona Republican Party sued to change the rules surrounding the electoral votes. It all started when Dr. Kelli Ward, chair of the Arizona GOP and friends, including Representative Louie Gohmert (R-TX) filed their paperwork. The Fifth Circuit Court of Appeals only needed eight hours and three minutes to challenge this Electoral Count Vote.

The three-judge panel did not bother to have Vice President Mike Pence, the defendant, “file a reply to the plaintiffs’ legal brief,” according to The Tuscon.com. These judges said they would review what was “filed in trial court” and US District Court Judge Jeremy Kernodle’s 13-page opinion. This judge threw the case out on the previous day on the issue of the right to sue.

The panel wrote a terse unsigned order that read:

‘We need say no more. We affirm the judgment essentially for the reasons stated by the district court.’

Although Pence’s attorneys did fight the lawsuit against him, he is amicable toward these Republican Trump minions’ intent. Chief of Staff to Vice President Pence, Marc Short released a statement on Saturday. It read:

‘Vice President Pence shares the concerns of millions of Americans about voter fraud and irregularities in the last election. The vice president welcomes the efforts of members of the House and Senate to use the authority they have under the law to raise objections and bring evidence before the Congress and the American people on January 6th.’

They said the results would be turned over to individual states to evaluate the commission’s findings, a move that they said would allow lawmakers in those states to:

‘[C]onvene a special legislative session to certify a change in their vote, if needed.’

Republican presidents appointed all of these judges, one of those was even appointed by Donald Trump. Unless the US Supreme Court intervenes, Congress will meet Wednesday and count the electoral votes that have been certified by each state and make President-elect Joe Biden the next American president. The electoral votes were 306 for Biden, which included 11 Arizona votes against Trump’s 232 votes. Ironically, that was the same number that this president won by in 2016 against Secretary Hillary Clinton.

There is a team of senators who intend to challenge the results in several swing states. They intend to reject electors from “disputed states,” states that he won in the 2016 election. This group wants an electoral commission “with full investigatory and fact-finding authority” to do an emergency 10-day audit of the states’ elections:

‘Under the Electoral Count Act, both the House and Senate vote separately on whether each state’s disputed votes should be counted. ‘If the two chambers disagree, however, then the votes of the electors whose appointments have been certified by the governor of each state are the ones counted, just like has been done in Arizona by Governor Doug Ducey. That would affirm Biden’s win.’
