Federal Lawsuit Already Filed Against Lauren Boebert

Rep. Lauren Boebert (R-Colo.) — a first-term Congresswoman who’s staked her political career on stunts like intending to carry a gun while on duty at the Capitol — is now facing a federal lawsuit from former Colorado state Representative Brianna Buentello, who Boebert recently blocked on Twitter. Boebert blocked Buentello — who’s a constituent of the Congresswoman — after the former state Rep. characterized Boebert’s behavior as “seditious” in the wake of the recent deadly rioting at the Capitol. Boebert pushed the lies about the election that helped incite this rioting, and, controversially, she tweeted out the approximate location of House Speaker Nancy Pelosi (D-Calif.) as rioters swarmed the Capitol building looking for top leaders, although Boebert has not admitted any kind of nefarious intent behind her dangerous ineptitude.

In her court case against the Congresswoman, Buentello alleges that Boebert’s blocking is a violation of the First Amendment because of Buentello’s subsequent exclusion from what, in the modern day, is a (digital) public space. In 2019, the Second U.S. Circuit Court of Appeals in Manhattan ruled against outgoing President Donald Trump in a similar case, concluding “that Trump violated the First Amendment whenever he blocked a critic to silence a viewpoint,” the Denver Post explains.

David Lane, an attorney for Buentello, commented as follows:

‘We are seeking a preliminary injunction mandating that Boebert stop violating the Constitution she swore an oath to ‘preserve, protect and defend’ little more than two weeks ago. Recently Donald Trump lost an almost identical case filed in New York when he was doing the same thing. Boebert has not learned that lesson.’

In the lawsuit, Lane also notes that those “who are blocked from [Boebert’s] account are impeded in their ability to learn information that is shared only through that account.” In a sworn statement accompanying the lawsuit, Buentello noted the First Amendment concerns, commenting as follows:

‘I wish to respond to Representative Boebert’s authoritarian policies as enunciated on her Twitter account. I believe she is a danger to our country and it is my right to alert the citizenry to that fact. In criticizing Representative Boebert online, I am engaged in petitioning my government for redress of my grievances. When blocked, this option of petitioning is foreclosed to me and I wish to continue to petition in this manner.’

After the violence at the Capitol, which proceeded under the pretense of outright lies about the electoral outcome, which the rioters were hoping to overturn, Boebert continued to push deranged election lies, commenting that “Hillary must be pissed it took the DNC until 2020 to successfully rig an election.” The 2020 election was not, in any respect, rigged. No court in the country has accepted this argument.
