The Department of Justice went to SCOTUS and asked the justices to throw out Donald Trump’s appeal over Mar-a-lago documents.
The DOJ appealed to the Supreme Court to rule that the Federal Court of Appeals for the 11th Circuit was right. By referring to the classified documents as “extraordinarily sensitive,” the DOJ meant it wanted to adhere to the Federal Court of Appeal’s ruling as it “blocked the special master’s access over those [100 top-secret] records while legal challenges play out.”
The DOJ appealed to the SCOTUS by writing, according to CNN:
‘As this Court has emphasized, courts should be cautious before “insisting upon an examination” of records whose disclosure would jeopardize national security ‘even by the judge alone, in chambers.’
US Solicitor General Elizabeth Prelogar wrote:
‘Indeed, the most that applicant could possibly establish about appellate jurisdiction in this case is that it presents a “difficult question.”‘
Trump took his case to his supporters at his last rally claiming loudly and vociferously:
‘I had a small number of boxes in storage. There is no crime. They should give me immediately back everything they have taken from me because it’s mine.’
Indeed, the documents were never Trump’s. The ex-president just wanted them, and few if any individuals have ever turned him down.
Last week, the former president directed his argument at the Supreme Court:
‘The Eleventh Circuit lacked jurisdiction to review, much less stay, an interlocutory order of the District Court providing for the Special Master to review materials seized from President Trump’s home.’
Donald Trump chose Judge Raymond Dearie to be his special master. And the ex-president argued his judge would be hindered by the 11th Court of Appeals’ ruling. In fact, it would impede Judge Dearie’s “ongoing time-sensitive work.”
The former POTUS’ attorneys argued:
‘Any limit on the comprehensive and transparent review of materials seized in the extraordinary raid of a President’s home erodes public confidence in our system.’
CNN SCOTUS analyst and University of Texas School of Law professor Steve Vladeck said:
‘Even in the unlikely event that the Court sides with Trump this time, all that means is that Judge Dearie gets to look at more of the files that were seized. It would have no impact on whatever the Department of Justice is doing with those materials.’
