Amid the fallout of the U.S. Supreme Court’s decision this week in the case where ex-President Donald Trump was claiming sweeping legal immunity by mere virtue of once serving as president, Rep. Dan Goldman (D-N.Y.) — an outspoken member of the House Oversight Committee — is sounding an alarm.

Among other points in a prepared statement issued after the court gave Trump and other presidents a covering of some legal immunity, Goldman called out Chief Justice John Roberts for the court moving forward precisely as it did with the proceedings at all.

“The compromised and conflicted Justices Thomas and Alito should never have heard this case. Chief Justice Roberts has abdicated his duty by failing to police and ensure the impartiality of his court,” Goldman argued on Monday. “Therefore, it is incumbent upon the Legislative Branch to preserve the constitutional foundation of our democracy as three co-equal branches of government.”

Concerns were previously raised about Justices Clarence Thomas and Samuel Alito over their argued personal connections to some of the same issues that hung in the balance in the Trump case, amid which Trump originally faced criminal accusations of conspiring to undercut the 2020 presidential election outcome, meaning Joe Biden’s electoral college win.

In Thomas’ case, his wife Ginni Thomas was a supporter of some targeting of Biden’s win, even speaking with then-White House chief of staff Mark Meadows about it. And regarding Alito, a news report revealed that an upside down American flag — like was seen amid the Capitol riot of January 2021 — was seen outside Alito’s residence, though the judge credited his wife. A later report said an “Appeal to Heaven” flag — imagery that also appeared at the Capitol riot — was outside another residence of the Alitos.
