Jack Smith Issues Notice Of Insider Testimony Against Trump At Trial

A new filing from federal prosecutors in the case accusing former President Donald Trump of a conspiracy targeting the 2020 election results appears to outline insider testimony on the way against Trump at trial, though the specific persons who would offer such testimony were not identified.

The context was a discussion from prosecutors of what Trump was doing at the White House as the riot at the Capitol unfolded… White House happenings for which the prosecution said they’ll have testimony and video evidence, necessitating some kind of inside perspective.

“Through testimony and video evidence, the Government will show that following his public remarks, the defendant returned to the White House and watched hours of television—including footage of crowds marching from his Ellipse event to the Capitol and swarming Capitol grounds, and news reporting of law enforcement injuries, threats inside the building, and lawmakers in hiding,” the new filing said. “Testimony will establish that the defendant was informed of, though indifferent to, the fact that the Vice President had to be evacuated from the Senate to a secure location.”

And of course, that transpired as the Congressional proceedings to certify the 2020 election results were forced on hold for hours. The prosecutors were rebuffing a motion from Trump to strike certain language related to January 6 from the indictment. Jack Smith’s team argued that details of the violence that took place that day are actually central to their case against him and provide necessary context for the alleged conspiracy, even if the specific terms of his criminal charges relate most directly to Trump’s affronts against the election results. Separately, prosecutors have also recently rebuked arguments from Trump that statements of his made at issue in this criminal case should be considered to be protected by the First Amendment.
